e-Exchange Terms and Conditions

If you do not accept these Terms and Conditions you will not be able to use e-Exchange Service.

e-Exchange

In these Terms and Conditions, the pronouns "I" and "Me" refer to the e-Exchange customer, the pronoun "Al Ansari", means Al Ansari Exchange Company, "e-Exchange" means e-Exchange online remittance services provided through this site and "Services" means the services available through e-Exchange from time to time.

In consideration of Al Ansari making available the Services through e-Exchange, I acknowledge, accept and abide by the following:

1. By using e-Exchange, I have accepted and agreed to be bound by the Terms and Conditions herein stated, as amended by Al Ansari from time to time. I agree to pay all fees, expenses or charges applicable to the e-Exchange Services which Al Ansari may charge from time to time.
   
   
2. I irrevocably and unconditionally accept as binding any transaction and/or instruction made or given through e-Exchange at my own risk and responsibility. Al Ansari's records of any transactions or instructions processed through e-Exchange shall constitute binding and conclusive evidence of such transaction or instruction for all purposes.
   
   
3. I agree that all security procedures used and implemented by Al Ansari are reasonable and adequate. I shall safeguard and maintain as secret and shall diligently safeguard from disclosure and/or use by any other person(s) my User ID's, passwords and all other items included in the security procedures, or any other authentication methods/devices, as Al Ansari may provide from time to time, from being disclosed to any third parties or unauthorized personnel. I further agree and undertake that:
   
   
   
   1. Al Ansari is not required to make any investigations regarding the identity of the user gaining access to e-Exchange, other than the User ID and/or passwords ("ID&P) provided in the security procedure, and any other additional security methods/devices implemented by Al Ansari at its discretion;
      
      
   2. I will be liable for the usage of the ID&P and any other authentication methods/devices used to access e-Exchange by authorized personnel, unauthorized personnel or any other third parties; and
      
      
   3. Al Ansari can reasonably rely on the authenticity of transactions conducted by a user accessing e-Exchange by use of the security procedures. If Al Ansari has reason to doubt the genuineness or authenticity of any instruction or transaction, Al Ansari may, in its discretion, choose not to process the instruction and/or transaction initiated through e-Exchange.
      
      
4. Al Ansari owns all information stored and transmitted through e-Exchange and shall have the right to review, monitor, change or delete such information for security or administration or any other purpose. I acknowledge that Al Ansari will not provide me any type of hardware and/or software for enabling the usage of e-Exchange.
   
   
5. I agree that Al Ansari may at its own discretion:
   
   
   
   1. Include additional products or services in connection with e-Exchange or discontinue some of the products and services provided in connection with e-Exchange;
      
      
   2. Restrict the usage of ID&P and/or any other authentication methods/devices; and
      
      
   3. Restrict or terminate my use of this service.
      
      
6. I acknowledge that access to some of the products or services available through e-Exchange may require additional processing within Al Ansari which may take time because of differences in time, business hours and business days between the place where the instruction or transaction is received and the place of accounts to be debited or credit.
   
   
7. I agree that e-Exchange is provided exclusively for my benefit. Al Ansari shall not be liable in any manner or form for providing e-Exchange, including but not limited to, any of the following:
   
   
   
   1. If I am unable to access and/or utilized e-Exchange due to any reason beyond Al Ansari's control including any technical, communication or network malfunction or breakdown;
      
      
   2. For any loss or damage that may arise or be incurred directly or indirectly by reason of Al Ansari's carrying out my transactions or instructions or from any malfunction or failure of e-Exchange;
      
      
   3. For any change, alteration, additions or deletions to these Terms and Conditions, e-Exchange, the systems of operation of e-Exchange or the daily cut-off times; or
      
      
   4. For any partial, incomplete, late or failed transfer or bill payment to any payee nominated under e-Exchange due to reasons beyond Al Ansari's control.
      
      
8. I accept that telegraphic transfers will be considered as executed unless any claim contrary to this is received from the me within 6 (six) months from the date of remittance.
   
   
9. I agree that refund against cancellation of telegraphic transfers, missing demand drafts or any payment orders returned unpaid for whatsoever reason will be only at the prevailing market rate after an advice confirming non-payment of the missing instrument and cancellation of Al Ansari original payment instruction is received by Al Ansari from its correspondent.
   
   
10. I agree that Al Ansari will not be responsible for any delay; mistake or omission caused in transmission and our liability is limited for emendation at shortest possible time on notice.
    
    
11. I accept that Al Ansari and e-Exchange are free to use service/s of intermediary banks/financial institutions in any country of their choice for the execution of this transfer. Correspondent / Intermediary charges are applicable to some countries and will be deducted at paying end.
    
    
12. I unconditionally accept that the remittance will be subject to laws related to monetary transactions in the U.A.E. on Anti-Money Laundering (AML) / intermediary / destined countries and may be blocked / frozen if found suspicious. I and my beneficiaries will be fully responsible to provide necessary evidence / clarification to prove genuinity and legality of entities / funds involved and to follow up with the authorities concerned for effecting payment or refund in such cases. In such cases, Al Ansari and e-Exchange will not bear any responsibility in this respect.
    
    
13. I agree that for transactions where payments are made offline, the rates and charges applicable on the day and time of actual payment by me will apply.
    
    
14. I agree that the facility of using e-Exchange is given to me exclusively for sending my personal payments only and in No way third parties payments is allowed or will be sent by me through this mode (e-Exchange). In case, e-Exchange has doubt on any of the payment sent through the system and which they suspect are beyond my scope / related field, the same may be stopped immediately by them till the time the Company is fully satisfied about its beneficial owner.
    
    
15. In using e-Exchange facility for outward remittances, I agree to follow the local & International AML laws and policies at all time. I undertake to provide full details of the beneficiaries as and when desired by the Company (Service Providers) or by the regulators within 48 hours time.
    
    
16. I undertake that the beneficiaries for which I will be sending the remittances are personally known to me and I will take full responsibility for their creditworthiness and genuineness.
    
    
17. I further undertake that the funds used by me for sending these remittances are mine and their sources have been my personal savings / business earnings / loan amount and in no way belongs to third parties.
